GTC

1. GENERAL

The version valid at the time the contract is concluded shall apply. Only the German language is available for the conclusion of the contract. The offers, services and deliveries of AGILE MOVEMENT are made exclusively on the basis of these General Terms and Conditions; the participant’s terms and conditions do not apply.

2. CONCLUSION OF CONTRACT

The presentation of offers for certificate courses and workshops does not constitute a binding offer, but a non-binding invitation to the participant to submit an offer. By submitting the registration form for a certificate course or workshop, the participant has bindingly registered for participation. The contract is concluded after acceptance of the registration by AGILE MOVEMENT in text form. Partial bookings of certificate courses and workshops and splits between several participants are not possible.

3. TERMS OF PAYMENT

The prices listed on this website apply to all certificate courses and workshops. Upon conclusion of the contract, 100% of the certificate course costs and workshop costs are due. The information for the purpose of payment processing will be sent by email. All prices are inclusive of VAT. If reminders are required, default costs of € 5.00 per reminder will be charged, subject to the assertion of further damages. § Section 288 para. 5 BGB remains reserved.

4. CANCELLATION / LIABILITY AGILE MOVEMENT

AGILE MOVEMENT is entitled to cancel agreed certificate courses and workshops if the minimum number of participants of 3 persons is not reached; as a rule, cancellation shall be made in text form no later than seven days before the announced start of the certificate course / workshop. Payments already made will be refunded to the participant; further claims (with the exception of injury to life, limb, health and gross negligence on the part of legal representatives, employees or other vicarious agents) are excluded.

5. COURSE CONDITIONS

The course instructors are authorized to set start and end times for certificate courses and workshops that deviate from the announcement as required. Course instructors are authorized to appoint substitutes. All certificate courses and workshops are held in accordance with the invitation to tender. The course instructor is responsible for presenting the content. Course participants undertake to follow the instructions of the course instructor. The course instructor may exclude persons from the certificate course or workshop who disrupt or hinder the certificate course or workshop or do not meet the course requirements. In this case, there is no right to reimbursement of the costs. The certificate course participant / workshop participant is responsible for any disadvantages resulting from late attendance.

6. WITHDRAWAL OF THE PARTICIPANT

The participant may withdraw from the contract at any time; the withdrawal must be made in text form. A substitute person is not permitted to participate in the certificate course or workshop. AGILE MOVEMENT is entitled to demand lump-sum compensation. The flat-rate withdrawal fee for the agreed course or workshop is 50% of the cost of the certificate course or workshop up to seven days before the start of the certificate course or workshop (receipt of withdrawal) and 100% of the cost if less than seven days before the start of the certificate course or workshop (receipt of withdrawal).

7. DISCUSSIONS

Verbal agreements are only effective if they have been confirmed in writing by AGILE MOVEMENT.

8. SEVERABILITY CLAUSES

The ineffectiveness of individual provisions shall not result in the ineffectiveness of the entire contract.
